Forecastify Terms of Service

1. Acceptance of Terms

By installing, accessing, or using the Forecastify app ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Forecastify is provided by SwiftSync ("Company," "we," "our," or "us"), a digital agency based in Sutton Coldfield, Birmingham, UK.

2. Description of Service

Forecastify is a Shopify app that provides inventory forecasting services for e-commerce businesses. The app analyzes your historical sales data to predict when products will run out of stock.

Core Features Include:

• Stock-out date predictions based on historical sales data
• Visual forecast graphs and reports
• CSV export functionality for data analysis
• Integration with Shopify inventory systems

Pro Features Include:

• Daily email reports and notifications
• Customizable alert thresholds
• Advanced reporting and analytics

3. Shopify Integration and Data Access

To provide our forecasting services, Forecastify requires access to your Shopify store data, including:

• Product information and inventory levels
• Historical sales and order data
• Store configuration and settings

By installing Forecastify, you grant us permission to access this data solely for the purpose of providing forecasting services. We do not store customer data or personal information from your orders.

4. User Accounts and Eligibility

To use Forecastify, you must:

• Have a valid Shopify store and account
• Be at least 18 years old or have legal capacity to enter contracts
• Provide accurate and complete information during setup
• Maintain the security of your account credentials
• Comply with Shopify's Terms of Service and acceptable use policies

You are responsible for all activities that occur under your account and for maintaining the confidentiality of your login credentials.

5. Subscription and Payment Terms

5.1 Free Plan

Forecastify offers a free plan with basic forecasting features. The free plan includes core functionality but may have limitations on the number of products or frequency of updates.

5.2 Pro Plan

Pro features are available through a paid subscription managed via Shopify's billing system. Subscription fees are processed according to Shopify's billing policies.

5.3 Billing and Cancellation

• Subscription fees are billed through Shopify's billing system
• You may cancel your subscription at any time through your Shopify admin
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial billing periods
• Free plan users may uninstall the app at any time

6. Acceptable Use Policy

You agree to use Forecastify only for lawful purposes and in accordance with these Terms. You must not:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to reverse engineer, decompile, or hack the app
• Use the service for any fraudulent or malicious activities
• Interfere with or disrupt the service or servers
• Share your account credentials with unauthorized parties

7. Data Accuracy and Limitations

Forecastify provides inventory predictions based on historical sales data and statistical algorithms. While we strive for accuracy, you acknowledge that:

• You should use forecasts as guidance alongside your business judgment

8. Intellectual Property Rights

The Forecastify app, including its design, functionality, algorithms, and content, is owned by SwiftSync and protected by copyright, trademark, and other intellectual property laws.

License Grant

We grant you a limited, non-exclusive, non-transferable license to use Forecastify solely for your business inventory management purposes in accordance with these Terms.

Your Data

You retain ownership of your business data. We only use your data to provide the forecasting service and as described in our Privacy Policy.

9. Service Availability and Maintenance

We strive to maintain high service availability, but cannot guarantee uninterrupted access. Service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Technical issues or server problems
• Shopify platform maintenance or outages
• Force majeure events beyond our control

We will make reasonable efforts to provide advance notice of scheduled maintenance when possible.

10. Disclaimer of Warranties

FORECASTIFY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• WARRANTIES OF NON-INFRINGEMENT OR TITLE
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE
• WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF FORECASTS

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIFTSYNC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Lost profits, revenue, or business opportunities
• Loss of data or inventory
• Business interruption or operational delays
• Costs of substitute services or products

Our total liability for any claims related to Forecastify shall not exceed the amount you paid for the service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless SwiftSync from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of Forecastify in violation of these Terms
• Your violation of applicable laws or third-party rights
• Your business decisions based on forecast data
• Unauthorized access to your account due to your negligence

13. Termination

13.1 Termination by You

You may terminate your use of Forecastify at any time by uninstalling the app from your Shopify store.

13.2 Termination by Us

We may terminate or suspend your access to Forecastify if you violate these Terms or engage in prohibited activities. We will provide reasonable notice when possible.

13.3 Effect of Termination

Upon termination, your access to Forecastify will cease, and any data we hold will be handled according to our Privacy Policy and data retention policies.

14. Privacy and Data Protection
