1. Acceptance of Terms

By downloading, installing, accessing, or using the JobSync mobile application ("App," "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use the Service.

JobSync is provided by SwiftSync ("Company," "we," "our," or "us"), a digital agency based in Sutton Coldfield, Birmingham, UK.

2. Description of Service

JobSync is a mobile application designed for trade businesses to manage jobs, teams, and schedules. The app facilitates job creation, assignment, tracking, and collaboration between business owners and their employees.

Core Features Include:

  • Job creation, assignment, and status tracking
  • Team collaboration and communication tools
  • File uploads for proof of work documentation
  • Calendar integration and scheduling
  • Business management with employee access
  • Data export and reporting capabilities
  • Push notifications for job updates

3. User Accounts and Eligibility

3.1 Eligibility Requirements

To use JobSync, you must:

  • Be at least 18 years old or have legal capacity to enter contracts
  • Provide accurate and complete information during registration
  • Use the service for legitimate business purposes only
  • Comply with all applicable laws and regulations
  • Maintain the security and confidentiality of your account

3.2 Account Types

  • Business Owner Accounts: Paid accounts that can create businesses, manage employees, and access all features
  • Employee Accounts: Free accounts that can join businesses using a 6-digit code and access assigned jobs

3.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access or security breaches.

4. Subscription and Payment Terms

4.1 Subscription Plans

  • Business Owner Subscription: £20 per month per business
  • Employee Access: Free for all employees
  • Free Trial: 7-day free trial for new business owner accounts

4.2 Billing and Payment

  • Subscriptions are billed monthly in advance
  • Payments are processed through App Store (iOS) or Google Play (Android)
  • All fees are in British Pounds (GBP) unless otherwise stated
  • Prices may be subject to applicable taxes
  • Failed payments may result in service suspension

4.3 Cancellation and Refunds

  • You may cancel your subscription at any time through your device's subscription settings
  • Cancellations take effect at the end of the current billing period
  • No refunds are provided for partial billing periods
  • Free trial cancellations prevent any charges
  • Refund requests are handled according to App Store and Google Play policies

5. Acceptable Use Policy

You agree to use JobSync responsibly and in accordance with these Terms. You must not:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the service for fraudulent, illegal, or harmful activities
  • Attempt to reverse engineer, decompile, or hack the application
  • Interfere with or disrupt the service or its servers
  • Upload malicious content, viruses, or harmful code
  • Harass, abuse, or harm other users
  • Share inappropriate, offensive, or illegal content
  • Use the service to compete with or create similar products
  • Share your account credentials with unauthorized parties
  • Attempt to gain unauthorized access to other accounts or data

6. Content and Data

You retain ownership of all content you create, upload, or share through JobSync, including:

  • Job descriptions, notes, and business information
  • Photos, documents, and files uploaded as proof of work
  • Client contact information and project details

6.2 Content License

By uploading content to JobSync, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service. We do not claim ownership of your content.

6.3 Content Standards

All content must comply with applicable laws and our community standards. You are responsible for ensuring your content does not infringe on third-party rights or contain inappropriate material.

6.4 Data Retention

We retain your data according to our Privacy Policy and data retention schedule. Files are automatically archived after 12 months and deleted after 24 months unless you opt for different retention settings.

7. Intellectual Property Rights

7.1 Our Rights

JobSync, including its design, functionality, algorithms, and content, is owned by SwiftSync and protected by copyright, trademark, and other intellectual property laws.

7.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to use JobSync solely for your business operations in accordance with these Terms. This license terminates when your access ends.

7.3 Restrictions

You may not copy, modify, distribute, sell, or lease any part of our service or included software, nor may you reverse engineer or attempt to extract the source code.

8. Service Availability and Support

8.1 Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or technical issues.

8.2 Customer Support

We provide customer support through in-app resources and email. Support response times may vary based on the complexity of your inquiry and current support volume.

8.3 Updates and Changes

We may update JobSync from time to time to add features, fix bugs, or improve performance. Some updates may require you to accept new terms or permissions.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

By using JobSync, you consent to the collection and use of information as described in our Privacy Policy.

10. Disclaimer of Warranties

JOBSYNC IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES OF NON-INFRINGEMENT OR TITLE
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • WARRANTIES REGARDING DATA ACCURACY OR RELIABILITY
  • WARRANTIES THAT THE SERVICE WILL MEET YOUR BUSINESS REQUIREMENTS

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIFTSYNC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Lost profits, revenue, or business opportunities
  • Loss of data, files, or work product
  • Business interruption or operational delays
  • Costs of substitute services or lost productivity
  • Damage to business reputation or relationships

Our total liability for any claims related to JobSync shall not exceed the amount you paid for the service in the 12 months preceding the claim, or £100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless SwiftSync from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of JobSync in violation of these Terms
  • Your violation of applicable laws or third-party rights
  • Content you upload or share through the service
  • Your business operations or employment relationships
  • Unauthorized access to your account due to your negligence
  • Your breach of any representations or warranties

13. Termination

13.1 Termination by You

You may terminate your use of JobSync at any time by:

  • Canceling your subscription through your device settings
  • Deleting the app from your device
  • Requesting account deletion through the app or by contacting us

13.2 Termination by Us

We may terminate or suspend your access to JobSync immediately if you:

  • Violate these Terms or our Acceptable Use Policy
  • Engage in fraudulent or illegal activities
  • Pose a security risk to our systems or other users
  • Fail to pay subscription fees when due

13.3 Effect of Termination

Upon termination, your right to use JobSync ceases immediately. We will handle your data according to our Privacy Policy and data retention schedule. You remain responsible for any outstanding fees.

14. Changes to Terms

We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices. We will notify users of material changes through the app, email, or other means.

Your continued use of JobSync after the effective date of any changes constitutes acceptance of the updated Terms. If you disagree with the changes, you must stop using the service.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of JobSync will be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Dispute Resolution

Before pursuing formal legal action, we encourage you to contact us directly to resolve any issues. Many concerns can be addressed through good faith discussion and compromise.

For subscription billing disputes, you may also contact the relevant app store (Apple App Store or Google Play Store) according to their dispute resolution procedures.

17. Additional Terms for Mobile Apps

17.1 App Store Terms

Your use of JobSync may also be subject to the terms and conditions of the platform from which you downloaded the app (Apple App Store or Google Play Store).

17.2 Device Permissions

JobSync may request access to certain device features (camera, storage, notifications, calendar) to provide its functionality. You can manage these permissions through your device settings.

17.3 Third-Party Services

JobSync may integrate with third-party services (calendar apps, cloud storage). Your use of these integrations is subject to the terms of those third-party services.

19. Entire Agreement
